Welcome to tabu.music and www.tabuofficial.com (collectively, the “Websites”), owned and operated by TABU the Artist LLC (“Company,” “we,” “us,” or “our”). By accessing or using either Website, you agree to these Terms of Use and our Privacy Policy (together, this “Agreement”).
1) Terms of Use
1.1 Acceptance of Terms
By using the Websites, you agree to be bound by this Agreement. If you do not agree, do not use the Websites.
1.2 Eligibility & Accounts
You must be 18+ to purchase or create an account.
You are responsible for your account credentials and any activity under your account.
1.3 Changes to this Agreement
We may update this Agreement at any time. Updates are effective upon posting to either Website. Continued use constitutes acceptance.
1.4 Permitted & Prohibited Use
You agree not to:
Violate any law or third-party rights (including IP rights).
Upload malicious code or attempt to disrupt the Websites.
Scrape, harvest, or misuse data beyond normal site use.
1.5 Intellectual Property
All content on the Websites (text, graphics, logos, images, audio, video, code, compilations) is owned by TABU the Artist LLC or licensed to us and protected by U.S. and international laws. You may not use, reproduce, distribute, or create derivative works without our written permission.
1.6 User Content & Feedback
If you submit content (comments, reviews, media) you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, host, reproduce, modify, and display such content for operation, promotion, and improvement of the Websites. If you send ideas/feedback, you agree we may use them without restriction or compensation.
1.7 Ecommerce; Payments; Pricing
Payments are processed by third parties (e.g., PayPal, Stripe, Apple/Google Pay) and subject to their terms and fees. We do not store full payment card details.
Taxes/Shipping: You are responsible for applicable taxes and shipping charges displayed at checkout.
Order Acceptance: We may refuse or cancel an order (e.g., suspected fraud, pricing errors, stock/fulfillment issues).
Digital Downloads: Delivery typically occurs via emailed link or on-screen download after payment. All sales of digital files are generally final unless required by law.
Merch & Print-on-Demand: Fulfilled by third-party partners (e.g., Printful/Printify or similar). Production and shipping timeframes vary. Color/size tolerances and minor variations are normal in apparel production.
1.8 Refunds & Returns (Summary)
Digital items: Typically non-refundable once delivered.
Physical merch: Returns/exchanges follow our posted store policy (defects/damages must be reported promptly with photos).
If a third-party fulfiller requires particular steps for returns, you must follow those steps.
1.9 Third-Party Services & Links
The Websites may link to third-party sites/services. We are not responsible for their content, terms, or policies.
1.10 Disclaimers
The Websites, content, products, and services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
1.11 Limitation of Liability
To the fullest extent permitted by law, TABU the Artist LLC and its officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; or for lost profits/revenue/data; arising from or related to your use of the Websites, even if advised of the possibility. Our total liability for any claim will not exceed the amount you paid to us for the product or service at issue in the prior 3 months.
1.12 Indemnification
You agree to defend, indemnify, and hold harmless TABU the Artist LLC from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Websites or violation of this Agreement.
1.13 DMCA / Copyright Complaints
If you believe material on the Websites infringes your copyright, send a notice to tabutheartist@gmail.com with: (a) your contact info; (b) identification of the work; (c) the infringing URL; (d) a statement under penalty of perjury of good-faith belief; (e) your signature. We may remove content at our discretion.
1.14 Governing Law & Venue
This Agreement is governed by the laws of the State of Texas (without regard to conflicts principles). Exclusive venue lies in the state and federal courts located in Bexar County, Texas.
2) Privacy Policy
2.1 Scope
This Privacy Policy covers tabu.music and www.tabuofficial.com and explains what we collect, how we use/share it, and your choices.
2.2 Information We Collect
Personal Information (you provide): name, email, shipping/billing address, phone, order details, support messages, account info.
Payment Information: processed by third-party processors (we do not store full card numbers).
